so who goes to jail, the car, the driver, or the programmer?
Probably the driver and who ever authorized turning off the emergency braking system.

in year 2500 it will likely be political correct to claim they evolved from apes...and the previous model (homo sapiens) could be their slaves by then...the scary is some would probably not mind.
