Continuing with my argument that maybe the service academies in the US deserve an affirmative action carve-out from whatever SCOTUS decides, consider the petitioner's (SFFA) argument that admission to elite schools is a "zero-sum game". Hence if you favor blacks, you are by implication discriminating against non-blacks. And, in particular, against Asian-Americans, the highest achieving group in terms of objective measure like the SAT, etc.
This argument seems compelling.
But, again, it doesn't seem to apply to the service academies because they are failing to meet their enrollment targets, and
need more applicants. So, the military academies, at least currently are *not* a zero-sum game.
