Question on H1-B status

This is what I did not know, just curious what if his or her first job is out of states after getting advanced degree from US, is this still applicable for this quota?one more question is how long does it take to get a work permit after getting married to US citizenship holder? No one is giving me a clear anwser on this. Thank you.

Bart: Usually employers will want to know very soon what your work status is. It will be one of the first things they ask, probably before any interview. Getting the visa will take some time and cost the employer some money. I would count on two months or so if you do everything quickly. Applying for a quant job in mid September may create some problems. Although they may look at the application date, not the issue date of the visa with respect to quota numbers. I am not sure about this.mcw: If your first job after your US degree is outside the states you should still be eligible for the extra quota. I got my visa this way.

Bart, here's my experience...I was shortlisted for a position in NY sometime early June. It did not push through as the October 2006 quota was already reached.I suggest you start earlier than Septermber... In fact you should try doing it on April 2007 when the window opens.

We might misunderstand each other. I was planning to start applying in September 2006, this coming September. Now I got to know that I will miss October 2006 and will be unable to start working until October 2007 unless there are some loopholes or exceptions that I am not aware of.Thus, the problem, the way I see it, is that if I start applying in September or October 2006 to start working in October 2007 they might think that it is too long to wait. And if I wait and apply say in March or April 2007 (just before the beginning of the visa application process) the company I will apply to might run out of available positions.I know that the market is currently good but some companies hire all year long and some finish their recruiting process by late fall or early winter.slik: I got my degree in the US and I am eligible for extra quota but I will miss it. I can't apply right now, for I am not yet prepared very well. I better prepare well and apply later than try my luck.

Hi Guys:I am not a lawyer ... so check with your immigration lawyer. There is an active forum at www.immigration.com - you may want to check this out. No, I am not connected with this firm.here is some info.1. The H-1 quota for 2006-07 is exhausted. The earliest one can apply for H-1 is April 1, 2007 for work starting Oct 1, 2007. One cannot apply more than 6 months before the start date.2. There is a bill (to increase the H-1 quota) pending in the US congress/senate. Let's hope this goes thru.3. Gap between jobs. Rules do not allow a H-1 visa holder to stay in the US for even one day after termination of position. Typically INS (now has a new name) allows some grace period but nothing concrete. There is one loophole: if the employer does not cancel the H-1 visa after termination, then one can stay in the US for the duration of the I-94 without future problems. 4. If one had a H-1 before (in the non-exempt category), then the cap does not apply.5. The extra 20,000 visa cap for US advanced degree recipients (MS, PhD etc) has also been reached as of July end, in case anyone is interested to know.

cgukhal is right, by a combination of happy accidents, corruption, and incompetence, it's a lot easier to come to Britain.

Which status status you have now on this non-profit job?--------------------------------------------------------------------------------H1-B The cap doesn't apply to you.
